This course is part of the bachelor Global Sustainability Science and fits within the track Governance and Societal Transformations. This course offers an introduction into EU environmental law. The aim of the course is on the one hand to offer insights into how the law can stimulate or hamper societal transformations and on the other hand to enable students to acquire basic legal skills. The specific course and learning goals are: 
  • Understand basic legal concepts (e.g. public law, private law), interpretation methods, legal institutions
  • Acquire basic legal skills: analysing legislation and case law, practicing legal arguing and solving legal questions
  • Understand the (relative) importance of environmental law in solving environmental problems.
  • Acquire knowledge of and insight in the structure and content of European environmental law and the interplay between international, European and national environmental law.
  • Gain knowledge about some specific areas of environmental law, e.g.: biodiversity protection and climate change.

Content

Environmental law can stimulate or hamper societal transformations. The focus of this course is on European environmental law. For EU Member States, the importance of EU environmental law cannot be overestimated. It aims to offer a high level of environmental protection with regard to goods on the internal market (from organic wine to cars and toys), the regulation of industries and farms, climate change, the protection of biodiversity, etc. There is a large body of EU legislation on a wide array of topics. Most EU environmental law is first transposed into national law and then implemented by the Member States. It is, therefore, necessary to also consider the impact of EU law in national situations. We also look at international conventions to which the EU is a party, as the EU is an important player which influences the development of international law and implements international law through EU law and the national laws of its Member States.
