Course goals

After this course:
  • the student has knowledge and understanding at an advanced level of the general tenets and rules of public international law, its history and operative institutions, and the various theoretical approaches to international law;
  • the student is able to analyze and reflect on the role of public international law in governing relations between states, as well as its function within domestic legal systems;
  • the student is able to identify the international law issues arising from contemporary developments with complex political and social contexts, to analyze these issues and to report on the findings in writing in a substantiated way;
  • the student is able to understand and critically engage with public international law jurisprudence and legal scholarship;
  • the student is able to independently and effectively conduct research in public international law, using authoritative legal sources, present to a peer audience and provide constructive feedback on the work of others, and structure ideas/arguments and communicate them effectively.

Content

This course functions as an advanced introduction into public international law, its foundational doctrines, principles and rules. We will go over the history of international law, its sources and subjects, the limits it places on the exercise of state power, how it is enforced and how international and domestic legal spheres interact. The course thereby creates a foundation of knowledge and skills upon which the specialized courses, moot court and thesis trajectory build further.
In the General Course we take a critical and contextual approach to public international law. We will discuss the main tenets of public international law in the light of their historical development, examining how they are shaped by the interests of particular actors, to the detriment of others. This means that, in addition to the canonical, positivist narrative, the course incorporates non-Western and critical perspectives on (the development of) international law and includes theoretical literature to complement the primary and secondary legal sources of the course.
