Course goals
After this course:- the student has studied selected family law issues from different perspectives, in particular a gender and a child perspective both in international law and European law (both ECHR and EU law).
- the student has in-depth knowledge of the main features of some selected family law issues in different legal systems.
- the student has developed his academic skills, in particular analytic, writing and presentation skills.
- the student has developed his critical thinking skills through teaching methods that encourage students to develop their own critical opinion on the topics addressed. In addition to lectures and reading of texts, literature and case law, weekly seminars provide the opportunity for debates, discussions and analysis of case law on current developments in family law.
Content
This course will focus on an international and comparative law perspective on family law. We will consider important and complex questions such as: What is the impact of international norms and human rights? How do we deal with new developments, such as surrogacy? We will deal with art. 8 ECHR and consider what a "family" is , we will reflect on (same-sex) partner relationships and on parent-child issues. How do gender, age and disabilities affect family law and what is the role of care? In addition, the course addresses private international law issues; in a globalizing world, the number of international family relationships increases every year. These are some of the topics and questions addressed in this master course on International and European Family Law (IEFL). The required knowledge before being allowed to participate in this course is: BA course Personen- en familierecht/ family law. IEFL combines various legal fields, perspectives and methods such as:
- International law (CEDAW)
- Human rights (CRC, ECHR, CRPD)
- EU Law
- Private International Law (Brussels IIbis, Rome III, MPR, Maintenance Regulation,Hague Conventions)
- Comparative family law
- Gender equality law
