Course goals

After this course:
  • The students have gained understanding and insight of different methodological perspectives: empirical, normative, doctrinal, interdisciplinary, and critical and the different fields of philosophy of science and theory of knowledge relevant to legal research;
  • The students have gained an understanding of the tension/interplay between the empirical and normative perspective and have gained the ability to reflect upon this tension;
  • The students, through group collaboration, are able to present the prescribed literature in a coherent way, and lead group discussions and dialogue;
  • The students have gained an understanding of the concept of positionality and its relevance for them as legal scholars; and are able to reflect upon their own position as a legal scholar;
  • The students have gained the skill set to write an academic paper in terms of design, methodology, perspective and is aware of the relevance and urgency of  academic integrity and its ethics, also in the context of the risks and possibilities of generative AI.

Content

Methodology I is the first of a series of four courses that engage you in different ways of researching law. Methodology I is an explorative journey to acquaint you with a variety of methodologies used in legal research and, perhaps more important, to teach (or show) you how different methodological, theoretical, and disciplinary perspec­tives on a research topic yield different kinds of insight. This “perspectiveness” strengthens your understan­ding of law and the ways you look at the law (in its wider societal and theoretical context). In doing so, Methodology I also pays attention to ethical considerations when conducting research including those concerning the use of generative AI tools and challenges you to reflect upon your own position as a legal researcher.
