Course goals

After this course: 
 
  • The students understand different external research approaches of law as they pertain to current views on empirical legal research;
  • The students understand the differences between law in the books, law in action legal, and empirical research, and know the differences between qualitative and quantitative research;
  • The students are able to write a research proposal by drafting a proposal of empirical legal research, including the grounding of suitable empirical legal methods to answers research questions;
  • The students are able to conduct a pilot study, using one of the empirical legal research methods;
  • The students can explicate the choices made in their draft research proposal by presenting their draft proposal and can provide feedback to others on the same;
  • The students understands ethics and academic integrity issues for researchers and can apply this knowledge when conducting  empirical legal research throughout all phases of the research and writing process.

Content

In this course we focus on how to develop a research proposal with a methodology that fits the research questions you want to answer. In the Methodology I  and II courses, you have considered  legal traditions and the use of sources for legal research and comparative work. In this course you will learn the basics of empirical legal research, encompassing both qualitative and quantitative research methods. To this end, this course introduces a range of techniques, such as interviews and surveys.. You learn step-by-step, how to write a sound and convincing empirical legal research proposal. You are free to choose a relevant research subject of your liking. You present your research proposal and give and receive feedback in order to improve your proposal.
