Course goals

After this course
  • The students can identify the impact of technologies on core values of the rule of law and more specifically on the protection of human rights, democracy, and access to legal remedies;
  • The students can explain the core concepts and principles of the applicable multi-layer human rights framework in Europe;
  • The students can examine specific cases of the intersection of state power, human rights and technology in light of the applicable multi-layer human rights framework in Europe;
  • The students can identify and critically reflect upon the role of the state with regard to the use of technologies from both a constitutional and criminal law perspective.

Content

Content (English)
 
The course will explore core issues of technology, state power and human rights. It will provide students with a solid understanding of how law, and in particular European human rights law, responds to the changing digital landscape, both at the level of the Council of Europe and the EU. The course will cover, among others, the impact of technologies on democracy and freedom of information, the relationship between algorithmic decision-making and the role of the judiciary, and the role of technology in the prevention and prosecution of crimes, such as child abuse or the dissemination of terrorist content.
